1. Overview & Who We Are
Waypoint Specialty is a specialty insurance Managing General Agency (MGA) headquartered at 3000 Bayport Drive, Suite 910, Tampa, FL 32607. We focus on commercial property coverage for private schools and nursing/care facilities and operate the Risk Rate web-based quoting platform for licensed insurance agents and brokers.
This policy applies to information collected through our website, the Risk Rate platform, email, telephone, and any related digital properties operated by Waypoint Specialty.
2. Information We Collect
Information you provide directly:
- Name, email address, phone number, and job title when submitting contact or quote-request forms
- Insurance license number and agency affiliation (for Risk Rate agent registration)
- Business name, address, industry type, and estimated annual revenue when requesting an indication or firm quote
- Attestations and underwriting details submitted during the Risk Rate Step 2 quoting process
- Communications you send us by email, chat, or phone
Information collected automatically:
- IP address, browser type, device identifiers, and operating system
- Pages visited, links clicked, and time spent on pages
- Referring URLs and search terms
- Cookie identifiers and similar tracking data (see Section 4)
Information from third parties:

- Generate insurance indications and facilitate firm quotes for licensed agents
- Communicate with you about your account, quote requests, policy questions, and product updates
- Verify agent licensing and eligibility for Risk Rate access
- Conduct underwriting analysis and risk assessment in connection with commercial property coverages
- Analyze website usage and platform performance to improve our services
- Deliver relevant advertisements through Google and Meta advertising platforms (see Section 5)
- Comply with legal and regulatory obligations applicable to insurance MGAs operating in Florida and other jurisdictions
- Detect and prevent fraud, unauthorized access, and other harmful activity

5. Advertising & Remarketing
We use Google Ads (including Google Display Network and YouTube) and Meta Ads (Facebook and Instagram) to reach prospective customers and insurance professionals. These platforms use cookies and similar tracking technologies to show you relevant ads based on your visits to our site and other sites across the internet.
Google Ads & YouTube: Third-party vendors, including Google, use cookies to serve ads to our site visitors based on their prior visits to our website or other websites. Google’s use of advertising cookies enables it and its partners to serve ads based on visits to our site and/or other sites on the internet. You may opt out of personalized advertising by visiting Google Ads Settings. We may also use Google’s remarketing features, Customer Match, and similar audience tools.
Meta (Facebook & Instagram): We use the Meta Pixel to measure the effectiveness of our advertising, build custom and lookalike audiences, and display relevant ads to people who have visited our website or taken specific actions. The Meta Pixel may collect your IP address, browser information, and behavioral data about your interactions with our pages. You can manage your ad preferences through Meta Ad Preferences.
We share information with Google and Meta only as necessary for advertising measurement services on our behalf, consistent with their respective data processing terms.

- ATTOM Data Solutions — property records and risk enrichment data for address lookups in Risk Rate
- Google LLC — Google Analytics, Google Ads, Google Tag Manager, YouTube advertising
- Meta Platforms, Inc. — Facebook and Instagram advertising, Meta Pixel
- Email and CRM platforms — for agent communication and marketing workflows
- Hosting and infrastructure providers — cloud hosting, security, and delivery services
These providers are contractually required to use your data only to perform services for us and in accordance with applicable law. We do not sell your personal information to third parties for their independent marketing purposes.
7. Risk Rate Platform — Agent Accounts
Risk Rate is Waypoint Specialty’s web-based commercial insurance quoting platform. Access is available in two modes:
- Step 1 — Indication: An automated indication available to licensed retail agents and, where permitted, commercial clients. Requires a business address, industry type, and estimated annual revenue. Waypoint Specialty and its data partners (including ATTOM Data) process this input to return enriched risk and property data.
- Step 2 — Firm Quote: Available exclusively to licensed insurance agents and brokers. Requires account registration, attestation of agent status, and submission of additional underwriting information.
By creating a Risk Rate account, you agree that:
- You are a licensed insurance professional authorized to access insurance rating systems in the applicable jurisdiction
- Account credentials are personal and may not be shared or transferred
- Waypoint Specialty may audit usage logs to ensure appropriate platform use
- Quote data, property enrichment results, and indication outputs generated through your account are subject to this Privacy Policy and our Terms of Service
- We may retain quote history and account activity for underwriting analysis, compliance, and platform improvement purposes
8. Sharing Your Information
We may share your information in the following circumstances:
- Service providers — vendors performing services on our behalf (hosting, analytics, advertising measurement, property data)
- Insurance carriers and reinsurers — to bind, issue, or service insurance policies
- Legal and regulatory compliance — when required by law, subpoena, regulatory examination, or to protect the rights and safety of Waypoint Specialty and others
- Business transfers — in connection with a merger, acquisition, or sale of company assets, subject to standard confidentiality protections
- With your consent — for any other purpose with your explicit agreement
We do not sell, rent, or trade your personal information to unaffiliated third parties for their own marketing purposes.
9. Data Security & Retention
We implement reasonable administrative, technical, and physical safeguards consistent with the Florida Information Protection Act (FIPA), Fla. Stat. §501.171, to protect personal information from unauthorized access, use, or disclosure. These measures include encrypted data transmission, access controls, and regular security reviews.
No method of transmission over the internet is completely secure. If you believe your account or data has been compromised, contact us immediately at the address in Section 12.
We retain personal information for as long as necessary to fulfill the purposes described in this policy, comply with legal obligations (including insurance record-keeping requirements), resolve disputes, and enforce our agreements. Account information for inactive Risk Rate accounts may be retained for up to seven (7) years for regulatory compliance purposes.
Data Breach Notification
In the event of a security incident that creates a risk of harm to individuals, we will notify affected parties and, where required, relevant authorities within the timeframes mandated by applicable law, including FIPA’s 30-day notification requirement.
10. Your Privacy Rights
Florida residents: While Florida does not have a broad consumer privacy rights law applicable to businesses of our size, we voluntarily honor the following requests:
- Access to or a copy of the personal information we hold about you
- Correction of inaccurate personal information
- Deletion of personal information, subject to legal retention obligations
- Opt-out of marketing communications at any time
California residents: If you are a California resident, you may have rights under the California Consumer Privacy Act (CCPA) / CPRA, including the right to know, the right to delete, and the right to opt out of the sale or sharing of personal information. We do not sell personal information as defined under the CCPA.
Other states: Residents of states with enacted comprehensive privacy laws (including Colorado, Connecticut, Virginia, Texas, and others) may have additional rights. Please contact us to exercise applicable rights.

Our website and the Risk Rate platform are intended solely for use by licensed insurance professionals and business entities. Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Waypoint Specialty website and the Risk Rate quoting platform. By accessing our site or creating a Risk Rate account, you agree to these Terms. If you do not agree, do not use our services.
13. Introduction & Agreement
These Terms constitute a legally binding agreement between you (“User,” “you,” or “Agent”) and Waypoint Specialty, LLC, a Florida limited liability company (“Waypoint Specialty,” “we,” “us,” or “our”) located at 3000 Bayport Drive, Suite 910, Tampa, FL 32607.
These Terms apply to all visitors, registered users, and licensed agents who access any portion of our website or the Risk Rate platform. Our Privacy Policy, which is incorporated herein by reference, also governs your use of our services.
14. Eligibility & Account Registration
You must be at least 18 years of age and, for Risk Rate Step 2 access, hold a valid and current insurance producer license in the applicable jurisdiction. By registering for a Risk Rate account, you represent and warrant that:
- All registration information you provide is accurate, current, and complete
- You have the legal authority to enter into these Terms on behalf of yourself or your agency
- You will maintain the accuracy of your account information and promptly update it if your license status changes
- You are responsible for all activity that occurs under your account credentials
- You will safeguard your login credentials and notify us immediately of any unauthorized account access
Waypoint Specialty reserves the right to verify licensing credentials and to decline or revoke access at its sole discretion.
15. Risk Rate Platform — Use & Limitations
Risk Rate is a commercial insurance quoting platform designed to provide premium indications and facilitate firm quote requests for eligible commercial properties. The following terms apply specifically to Risk Rate use:
Step 1 — Indication Access:
- Automated indications are provided for informational purposes only and do not constitute a binding insurance offer, commitment to insure, or guarantee of coverage
- Indication results are dependent on the accuracy of the address, industry type, and revenue information provided by the user
- Waypoint Specialty reserves the right to modify, withdraw, or decline to issue any indication at its sole underwriting discretion
Step 2 — Firm Quote Access:
- Available exclusively to licensed insurance agents and brokers who have completed account registration and attestation
- Submission of underwriting information in Step 2 does not bind coverage; binding is subject to separate written confirmation from Waypoint Specialty or an authorized carrier
- Agents are responsible for the accuracy and completeness of all information submitted on behalf of their clients
- Quote outputs may not be shared with, or presented to, third parties in a manner that implies a binding commitment
Platform Availability: We do not guarantee uninterrupted or error-free access to Risk Rate. We reserve the right to suspend, modify, or discontinue any feature of the platform at any time with or without notice.
16. Acceptable Use
You agree not to use our website or Risk Rate platform to:
- Submit false, misleading, or fraudulent information in any form or quote request
- Impersonate another person, agent, or entity or misrepresent your licensing credentials
- Reverse-engineer, scrape, or systematically extract data from the platform without our express written permission
- Introduce malware, viruses, or any code intended to disrupt or damage our systems
- Circumvent any security, access control, or authentication measures
- Use automated scripts or bots to access or query Risk Rate without authorization
- Violate any applicable federal, state, or local law, including insurance regulations
- Use indication or quote data for purposes unrelated to the placement of insurance coverage
Violation of these acceptable use standards may result in immediate account suspension and may be reported to applicable state insurance regulatory authorities.
17. Intellectual Property
All content on the Waypoint Specialty website and within the Risk Rate platform including text, graphics, logos, interface design, data models, and software is the property of Waypoint Specialty, LLC or its licensors and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use our website and Risk Rate platform solely for your internal business purpose of evaluating and placing commercial insurance. This license does not include the right to reproduce, distribute, modify, create derivative works from, or commercially exploit any portion of our platform or content.
The “Waypoint Specialty” name, “Risk Rate” name, and any associated logos are proprietary marks of Waypoint Specialty, LLC. Nothing in these Terms grants you any right to use our marks without prior written consent.
18. Disclaimers & Limitation of Liability
No Insurance Advice: Information provided through our website and the Risk Rate platform does not constitute insurance, legal, financial, or professional advice. Premium indications are estimates only. Coverage terms, conditions, and final pricing are determined by the applicable insurance carrier.
As-Is Basis: Our website and Risk Rate platform are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: To the fullest extent permitted by applicable law, Waypoint Specialty’s aggregate liability to you for any claims arising out of or related to these Terms or your use of our services shall not exceed the lesser of (a) the amount you paid us in the twelve months preceding the claim, or (b) $500. In no event shall we be liable for indirect, incidental, consequential, special, or punitive damages.
Some jurisdictions do not allow certain limitations of liability; the above limitations apply to the fullest extent permitted by law in your jurisdiction.
19. Termination
We reserve the right to suspend or terminate your access to the Risk Rate platform or our website at any time, with or without cause or notice, including for violation of these Terms, suspected fraudulent activity, or loss of valid insurance licensing.
Upon termination, your right to use Risk Rate ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property rights, disclaimers, indemnification, and governing law) will survive.
You may close your Risk Rate account at any time by contacting us at support@waypointspecialty.com. Account closure does not affect Waypoint Specialty’s right to retain data as required by law or for legitimate business purposes consistent with our Privacy Policy.
20. Governing Law, Disputes & Miscellaneous
Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
Dispute Resolution: Any dispute arising out of or relating to these Terms or your use of our services shall first be subject to good-faith negotiation between the parties. If not resolved within 30 days, disputes shall be resolved by binding arbitration in Hillsborough County, Florida, in accordance with the rules of the American Arbitration Association. Nothing herein prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property or unauthorized platform access.
Class Action Waiver: You agree to resolve disputes with Waypoint Specialty on an individual basis only and waive any right to participate in a class action or representative proceeding.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Waypoint Specialty regarding your use of our services and supersede all prior agreements or understandings.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
